Terms of Service
1. Agreement
These Terms of Service ("Terms") are an agreement between you and the operator of WhoIsTrading ("we", "us") for your use of WhoIsTrading at https://whoistrading.com and related services (the "Service"). By creating an account, accepting these Terms in the Service, or using the Service, you agree to these Terms, the Privacy Policy and the Risk Disclosure. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. You may not use the Service if you are barred from doing so under applicable law, or from a country or on a list subject to sanctions. You are responsible for making sure that using the Service and trading in your chosen markets is lawful where you live. We may require approval before an account can be used and may refuse or end access at our discretion.
3. What the Service is — and is not
WhoIsTrading is software. It lets you research markets, build and test rules, and send instructions you configure to a brokerage account that you hold in your own name, using API credentials you provide.
- We are not a broker-dealer, investment adviser, commodity trading advisor, exchange, bank or custodian.
- We do not hold your money or securities, do not trade for our own account against you, and do not receive payment for order flow.
- Orders are placed and executed by your broker under your agreement with that broker. Your broker, not us, is responsible for execution, custody, account statements, margin and regulatory reporting.
4. No investment advice
All information in the Service — including market data, scanner results, signals, scores, strategy templates, backtests, validations, regime indicators, AI-generated text and educational content — is general and impersonal. It is not a recommendation or solicitation to buy or sell any security or other instrument, and it does not take into account your objectives, financial situation or needs. You alone decide whether to trade, what to trade and how much risk to take. Consider consulting a licensed financial professional before making investment decisions.
5. Your account and security
Keep your sign-in method, authenticator and trade PIN secure and do not share your account. You are responsible for all activity under your account, including activity by automation you configure. Tell us promptly at support@whoistrading.com if you suspect unauthorized access. We may suspend access to protect you, other users or the Service.
6. Your broker and API credentials
Your relationship with your broker and with any data or AI provider you connect is governed by your agreements with them. By saving credentials you authorize us to use them to send the requests and instructions you configure — for example, reading account data and placing, changing or cancelling orders. We store credentials encrypted and never sell them. You can remove credentials at any time; you should also revoke them at the provider if you believe they are exposed. We are not responsible for the acts, omissions, outages, fees, fills or account restrictions of any broker or provider.
7. Automated trading
Automated features (including bots, scanners and agents) act on rules and limits you set and may place orders without asking you again once you start them. Software, data feeds, internet connections, brokers and markets can fail, delay or behave unexpectedly, and automation can produce losses quickly. You agree to: start with paper trading; review settings before going live; monitor your account and positions; and keep risk within what you can afford to lose. Risk controls such as stop orders, limits, pauses and halts are tools, not guarantees — for example, a stop order may fill far from its price in a fast or gapping market, or not at all. Live trading features are disabled by default and require separate approval.
7A. Crypto-asset exchanges
The Crypto Bot connects to a crypto-asset exchange account that you open and hold in your own name (for example KuCoin, Binance, Bybit, OKX, Kraken or Coinbase). We are not an exchange, custodian, money transmitter or crypto-asset service provider, and we never hold your coins or funds.
- Eligibility is your responsibility. Exchanges decide which countries they serve and many do not serve residents of the United States or other jurisdictions. You must only connect an exchange, and only trade crypto-assets, that are lawful for you where you live. Do not use a VPN or false information to get around an exchange's restrictions.
- Trading-only keys. Create API keys with trading permission only and never enable withdrawal or transfer permission. The Service never requests withdrawals or transfers. Restrict keys by IP address where your exchange allows it.
- Spot only. The Crypto Bot buys and sells crypto-assets for quote currency. It does not use margin, leverage, futures, options or lending.
- The Crypto Bot is separate from any stocks bot: it has its own settings, account and limits. Both may run at the same time and each can lose money independently.
8. Third-party data and services
Market data, news, filings and other third-party content may be delayed, incomplete or wrong and are provided as received. Data you obtain through your own provider subscriptions is subject to that provider's terms, including any personal-use or display restrictions, and you are responsible for complying with them. Links to third-party sites are for convenience only.
9. Fees and subscriptions
Some features may be offered on paid plans. If you buy a plan, the price, billing period and included features are shown before you pay; payments are processed by our payment provider; plans renew automatically until cancelled; and you can cancel at any time with effect from the end of the current period. Fees are non-refundable except where required by law or stated otherwise at purchase. We may change prices with advance notice; changes apply from your next billing period. You are responsible for applicable taxes. Paper trading and broker charges are separate; any fees charged by your broker or data providers are between you and them.
10. Acceptable use
You must not: use the Service for any unlawful purpose or to manipulate markets (including spoofing, layering, wash trading or front-running); interfere with or overload the Service; probe or test its security without our written permission; access it by automated means other than features we provide; copy, resell or redistribute the Service or third-party data obtained through it; reverse engineer it except where the law allows; impersonate others; or upload malicious code.
11. Intellectual property
The Service, including its software, design and content, belongs to us or our licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service under these Terms. You keep ownership of the content you create, such as watchlists, notes and strategy settings, and give us a licence to host and process it only to provide the Service. If you send feedback, we may use it without obligation to you.
12. Changes and availability
We may add, change or remove features, and may suspend the Service for maintenance or security. Some features are marked as research-only, experimental or paper-only and may change. We do not promise that the Service will be uninterrupted, error-free or available at any particular time, unless we agree otherwise in writing.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee any trading outcome, profit or the accuracy of any data, signal, backtest or AI output. Hypothetical, simulated and paper results have inherent limitations described in the Risk Disclosure.
14. Limitation of liability
To the fullest extent permitted by law: we are not liable for any trading losses, lost profits, lost data, or indirect, incidental, special, consequential or punitive damages arising from or related to the Service; and our total liability for all claims relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim arose and USD 100. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or, where applicable, for death or personal injury caused by negligence, or your statutory rights as a consumer.
15. Indemnity
To the extent permitted by law, you will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, your trading, or your violation of law or the rights of others.
16. Suspension, termination and account deletion
You may stop using the Service and delete your account at any time from Account settings. Before deleting, stop any automation; positions and orders at your broker remain yours and are not closed by deletion. We may suspend or end your access if you breach these Terms, if required by law, or to protect users or the Service. Sections that by their nature should survive termination (including 4, 7, 13, 14, 15 and 17) survive.
17. Governing law and disputes
These Terms are governed by the laws of the place where the operator of WhoIsTrading is established, without regard to conflict-of-law rules, except where the law of your country of residence gives you mandatory rights or the right to bring proceedings where you live. Before starting formal proceedings, please contact us at support@whoistrading.com and give us 30 days to try to resolve the matter informally.
18. Changes to these Terms
We may update these Terms. When a change is material we will ask you to review and accept the new version in the Service before you continue using it. The version and effective date are shown at the top of this page.
19. General
These Terms, the Privacy Policy and the Risk Disclosure are the entire agreement about the Service. If any part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a reorganisation or sale of the Service.
